State Seeks Immunity for Witnesses of Hinsdale South Grad's Murder

Prosecutors in the case of Juan Cuellar, the 23-year-old unincorporated Willowbrook man accused of shooting to death Hinsdale South graduate Joshua Holmes, have filed paperwork stating they will give immunity to two witnesses who might not otherwise testify to what they know about the killing, court records show.

The witnesses, both identified as women, would likely refuse to testify or "produce evidence" for fear of self-incrimination without immunity protection, prosecutors stated in the court filing.

Records do not elaborate on the content of their potential testimony. Cuellar remains in DuPage County Jail without bond. He is scheduled for an Oct. 22 hearing.

Cuellar's mother, Elva Hernandez, is also scheduled to appear in court the same day on an obstruction of justice charge. Prosecutors say she concealed the gun Cuellar used in the shooting. Hernandez has filed a speedy trial demand in her case.
